RESOLUCION 1958 sobre "Petróleo por Alimentos"

TEXTO DE LA RESOLUCIÓN DEL CONSEJO DE SEGURIDAD 1958

El Consejo de Seguridad,

Recordando sus resoluciones anteriores sobre la situación en Irak, en particular las resoluciones 986, 1472, 1476, 1483 y 1546, y el Informe del Secretario General de conformidad con el párrafo 5 de la resolución 1859 (2008),

Recordando la necesidad de "Petróleo por alimentos" (en adelante "el Programa") establecido en virtud de la resolución 986 (1995) como una medida provisional para atender las necesidades humanitarias del pueblo iraquí,

Reconociendo la importancia de lograr la posición internacional de Irak igual a la que se celebró antes de la aprobación de la resolución 661,

Reconociendo la importancia de las actividades de la oficina de Alto Nivel del Secretario General del Coordinador establecido en virtud de la resolución 1284 (1999),

Recordando la carta del Secretario General, de fecha 8 de diciembre de 2010 y la Nota adjunta al mismo, S/2010/619, el tercer informe del Secretario General de conformidad con el párrafo 3 de la resolución 1905 (2009), S/2010/563, y el tercer informe trimestral del Gobierno del Iraq de conformidad con el párrafo 5 de la resolución 1905 (2009), S/2010/567,

Tomando nota de la carta del Gobierno del Iraq al Presidente del Consejo de Seguridad, de fecha 6 de diciembre de 2010,

Actuando en virtud del Capítulo VII de la Carta de las Naciones Unidas,

1. Pide al Secretario General que tome todas las medidas necesarias para terminar todas las actividades residuales en el marco del Programa, señalando que todas las cartas de crédito con las reclamaciones pendientes de entrega, que se enumeran en el Anexo 1 a la Nota del Secretario General, de fecha 8 de diciembre de 2010, S/2010 / 619, han vencido en sus propios términos y que no hay confirmación de llegada será proporcionado por el Gobierno de Irak y se cierran a todos los efectos en el marco del Programa, incluyendo los efectos de la transferencia de los fondos asociados con dichas cartas de crédito de la porción de activos de garantía de la Cuenta para el Iraq a la parte no-garantía de la Cuenta para el Iraq, sin perjuicio de cualesquiera derechos o reclamos que los proveedores de las reclamaciones de la entrega puede tener para el pago, o de otro tipo, contra el Gobierno de Iraq en virtud de sus respectivos contratos comerciales con el Gobierno de Irak;

2. Toma nota del Gobierno de la prestación de Irak de los certificados de llegada en los archivos de las Naciones Unidas el 15 de diciembre de 2010, cuyo pago no se han efectuado ya sea como resultado de el banco asesor no poder localizar a los beneficiarios pertinentes o como resultado de el beneficiario no proporcionar la documentación necesaria, como se indica en la Nota del Secretario General, de fecha 8 de diciembre de 2010, párrafos 11 y 12 y los anexos II y III, y exhorta al Gobierno del Iraq a proporcionar sin demora el pago directo si entra en contacto por los beneficiarios o sus representantes;

3. Autoriza al Secretario General que establezca una cuenta de garantía bloqueada a los efectos de los apartados 4 y 5 de la presente resolución, para nombrar los contadores públicos independientes y certificados para realizar una auditoría, y que mantenga el Gobierno del Iraq plenamente informado;

4. Autoriza al Secretario General que vele por que 20 millones de dólares de los Estados de la Cuenta para el Iraq se mantienen en la cuenta de depósito en garantía hasta el 31 de diciembre de 2016, exclusivamente para los gastos de las Naciones Unidas relativas a la terminación ordenada de las actividades residuales del Programa, incluyendo apoyo de la Organización de investigaciones de los Estados miembros y los procedimientos Estado miembro relacionadas con el Programa, y los gastos de la oficina del coordinador de alto nivel ha creado de conformidad con la resolución 1284 y pide además que todos los fondos restantes serán transferidos al Gobierno del Iraq el 31 de diciembre 2016;

5. Autoriza al Secretario General que vele por que hasta 131 millones de dólares de los Estados de la Cuenta para el Iraq se mantienen en la cuenta de depósito con el fin de proporcionar indemnización a las Naciones Unidas, sus representantes, agentes, contratistas independientes y por un período de seis años con respecto a todas las actividades en relación con el Programa desde su creación, y pide además que todos los fondos restantes serán transferidos al Gobierno de Irak antes del 31 de diciembre de 2016;

6. Autoriza al Secretario General para facilitar la transferencia lo antes posible de todos los fondos restantes, más allá de las retenidas a los efectos de los apartados 4 y 5, de la Cuenta para el Iraq creado de conformidad con el párrafo 16 (d) de la resolución 1483 (2003) a la Fondo de Desarrollo de Iraq;

7. Pide al Secretario General que tome todas las medidas necesarias para garantizar la aplicación efectiva de la presente resolución y que entrará en todas las medidas necesarias de ejecución o los acuerdos lo antes posible con el Gobierno de Irak:

(A) proporcionar indemnización adecuada, como se indica en el párrafo 5, a las Naciones Unidas, sus representantes, agentes y contratistas independientes, con lo que se refiere a todas las actividades en relación con el Programa desde su creación y

(B) establecer una renuncia a cualquier reclamo futuro, el Gobierno de Iraq pueda tener en contra de las Naciones Unidas, sus representantes, agentes y contratistas independientes en relación con todas las actividades en relación con el Programa desde su inicio, como se indica en los párrafos 19 , 20, y 21 en S/2008/492, y le pide que informe al Consejo cuando lo ha hecho;

8. Pide al Secretario General que informe y proporcionar análisis al Consejo sobre el uso y gastos de la cuenta de garantía bloqueada hace referencia en los apartados 4 y 5 sobre una base anual, la primera antes del 31 de marzo de 2012, con el informe final se producen tres meses después la transferencia de los fondos restantes, para los fines de los apartados 4 y 5 para el Gobierno del Iraq el 31 de diciembre de 2016, a menos que sea autorizado por el Consejo de Seguridad;

9. Decide seguir ocupándose activamente de la cuestión.

Adopted by the Security Council at its 6450th meeting, on 15 December 2010

The Security Council,

Recalling its previous resolutions on the situation in Iraq, in particular
resolutions 986, 1472, 1476, 1483, and 1546, and the Report of the Secretary-
General pursuant to paragraph 5 of resolution 1859 (2008),

Recalling the need for the “Oil-for-food” Program (hereinafter “the Program”)
established under resolution 986 (1995) as a temporary measure to provide for the
humanitarian needs of the Iraqi people,

Recognizing the importance of Iraq achieving international standing equal to
that which it held prior to the adoption of resolution 661,

Recognizing the importance of the activities of the Secretary-General’s High-
Level Coordinator’s office established pursuant to resolution 1284 (1999),
Recalling the Secretary-General’s letter, dated 8 December 2010 and the Note
attached thereto, S/2010/619, the third report of the Secretary-General pursuant to
paragraph 3 of resolution 1905 (2009), S/2010/563, and the third quarterly report of
the Government of Iraq pursuant to paragraph 5 of resolution 1905 (2009),
S/2010/567,

Noting the letter from the Government of Iraq to the President of the Security
Council, dated 6 December 2010,

Acting under Chapter VII of the Charter of the United Nations,

1. Requests the Secretary-General to take all actions necessary to terminate
all residual activities under the Program, noting that all letters of credit with
outstanding claims of delivery, listed in Annex 1 to the Secretary-General’s Note,
dated 8 December 2010, S/2010/619, have expired according to their terms and that
no confirmation of arrival will be provided by the Government of Iraq and are
closed for all purposes under the Program, including for purposes of transferring the
funds associated with such letters of credit from the collateral portion of the Iraq
Account to the non-collateral portion of the Iraq Account, without prejudice to any
rights or claims that the suppliers with claims of delivery may have for payment, or
otherwise, against the Government of Iraq under their respective commercial
contracts with the Government of Iraq;

2. Notes the Government of Iraq’s provision of certificates of arrival on file
with the United Nations as of 15 December 2010, for which payment has not been
effected either as a result of the advising bank not being able to locate the relevant
beneficiaries or as a result of the beneficiary not providing requisite documentation,
as referenced in the Secretary-General’s Note, dated 8 December 2010, paragraphs
11 and 12 and Annexes II and III, and calls upon the Government of Iraq to provide
without delay direct payment if contacted by the beneficiaries or its representatives;

3. Authorizes the Secretary-General to establish an escrow account for the
purposes of paragraphs 4 and 5 of this resolution, to appoint independent and certified
public accountants to audit it, and to keep the Government of Iraq fully informed;

4. Authorizes the Secretary-General to ensure that 20 million United States
dollars of the Iraq Account are retained in the escrow account until 31 December
2016, exclusively for the expenses of the United Nations related to the orderly
termination of the residual activities of the Program, including the Organization’s
support to member State investigations and member State proceedings related to the
Program, and the expenses of the high-level coordinator’s office created pursuant to
resolution 1284 and further requests that all remaining funds are to be transferred to
the Government of Iraq by 31 December 2016;

5. Authorizes the Secretary-General to ensure that up to 131 million United
States dollars of the Iraq Account are retained in the escrow account for the purpose
of providing indemnification to the United Nations, its representatives, agents, and
independent contractors for a period of six years with regard to all activities in
connection with the Program since its inception, and further requests that all
remaining funds are to be transferred to the Government of Iraq by 31 December
2016;

6. Authorizes the Secretary-General to facilitate the transfer as soon as
possible of all funds remaining, beyond those retained for the purposes of
paragraphs 4 and 5, from the Iraq Account created pursuant to paragraph 16 (d) of
resolution 1483 (2003) to the Development Fund of Iraq;

7. Requests the Secretary-General to take all necessary actions to ensure the
effective implementation of this resolution and to enter into all necessary implementing
arrangements or agreements as soon as possible with the Government of Iraq:
(a) to provide appropriate indemnification, as referenced in paragraph 5, to
the United Nations, its representatives, agents, and independent contractors, with
regard to all activities in connection with the Program since its inception and

(b) to provide for a waiver of any future claims the Government of Iraq may
have against the United Nations, its representatives, agents, and independent
contractors with regard to all activities in connection with the Program since its
inception, as referenced in paragraphs 19, 20, and 21 in S/2008/492, and requests
him to report to the Council when he has done so;

8. Requests the Secretary-General to report and provide analysis to the
Council on the usage and expenditure of the escrow account referenced in
paragraphs 4 and 5 on an annual basis, the first no later than 31 March 2012, with
the final report occurring three months after the transfer of any remaining funds
retained for the purposes of paragraphs 4 and 5 to the Government of Iraq by
31 December 2016, unless otherwise authorized by the Security Council;

9. Decides to remain actively seized of the matter.
